By accessing or using the Site, you understand and that the ScanDigital.com site and services (the “Site” and/or “Service(s)”) are offered to you subject to these Terms of Use (hereinafter, the “Terms of Use” or “Terms”) and our Privacy Policy (available at https://scandigital.com/pages/privacy-policy). These Terms of Use describe the terms and conditions applicable to your use of the Services. Please review these Terms of Use regularly. By using the Site or Services, you agree to be bound by these Terms of Use.

You agree not to upload or transmit any photograph, image, advertisement, graphic, video, file, design, template or text (collectively, “Content”) that: (i) infringes upon any third party intellectual property rights; (ii) is abusive, harassing, defamatory, obscene or otherwise objectionable; (iii) violates any law or regulation; or (iv) contains viruses, spyware or other potentially harmful code. You also agree not to use the Site to solicit personal information from minors, or to engage in any activity that is harmful to any user, including but not limited to stalking, spamming or impersonation of another person or company.

In order to use or access the Services, you must be 18 years of age or older.

There is no cost to become a member of the Site.

You agree to provide complete and accurate contact and payment information about yourself when such information is requested by the Service in order to create your account. You agree to keep this information up to date at all times.

By accessing the Site, you acknowledge and agree that the ScanDigital Privacy Policy (https://scandigital.com/pages/privacy-policy) is incorporated herein by reference.

You agree to indemnify, defend and hold ScanDigital and its officers and employees harmless from any liability, claim or expense (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms of Use.

When placing any order, you agree to pay the applicable charges and to maintain valid payment information for the duration of the order. You consent to receive electronic communications from ScanDigital regarding your order and/or your use of the Site.

All orders are processed in the manner selected by you at the time the order is placed. Since every order is custom produced, refunds can only be issued under extraordinary circumstances.

All gift cards are provided as digital codes and are redeemable via e-mail; they are not redeemable as cash. Gift cards are non-transferable and cannot be resold.

ScanDigital reserves the right to delete your account if it remains inactive for 24 months or more.

Files and other material submitted by you may retain data or metadata. You agree that ScanDigital is not responsible for the retention or deletion of such embedded data.

The Site and all content displayed thereon (including documents, source code, graphics, logo designs, images, slogans etc.) are the exclusive property of ScanDigital or its licensors and are protected by United States and international intellectual property law.

ScanDigital may display or link to content provided by third parties. We do not endorse and are not responsible for any such content or third-party sites.

Links to third-party sites are provided solely for your convenience. Any such sites are subject to their own terms and conditions. ScanDigital is not responsible for the availability or accuracy of such third-party sites.

ScanDigital reserves the right to terminate your membership or access to the Site at any time for violation of the Terms of Use or other legitimate reason.

By submitting any ideas or suggestions to ScanDigital, you grant to ScanDigital an unrestricted and royalty-free right to use, display, reproduce or distribute such feedback.

The Site and Services are provided "AS IS" without warranties of any kind, whether express or implied. ScanDigital specifically disclaims any warranties of merchantability or fitness for a particular purpose.

ScanDigital is not liable for any loss or damage of content during shipment or delivery. You should retain your own backups of all original content prior to shipment.

In the event that media is returned to you for any reason, ScanDigital reserves the right to refuse any further service on such returned items.

You agree to comply with all applicable federal, state and local laws regarding your use of the Site and Services.

These Terms comprise the entire agreement between you and ScanDigital with respect to your use of the Site. Any failure by ScanDigital to enforce any provision of the Terms shall not constitute a waiver of such provision. If any provision of the Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
